1स्वीकृति
www.thenayak.in का उपयोग करके, profile बनाकर, नामांकन प्रस्तुत करके, जन-प्रतिक्रिया देकर या किसी भी सेवा का उपयोग करके आप इन उपयोग की शर्तों, Privacy Policy, Code of Conduct और अन्य प्रकाशित नीतियों को स्वीकार करते हैं। यदि आप इन शर्तों से सहमत नहीं हैं, तो वेबसाइट या इसकी सेवाओं का उपयोग न करें।
2मंच का उद्देश्य
THE NAYAK एक स्वतंत्र, गैर-दलीय नागरिक जागरूकता, जन-संवाद और नेतृत्व-विकास मंच है। इसका उद्देश्य नागरिकों को अपनी सोच, सामाजिक कार्य, स्थानीय समस्याओं की समझ और विकास-दृष्टि प्रस्तुत करने का अवसर देना है।
यह मंच चुनाव, मतदान, मतगणना, राजनीतिक टिकट वितरण, MP/MLA चयन या चुनावी परिणाम घोषित करने का मंच नहीं है।
3उपयोगकर्ता की पात्रता
वेबसाइट का उपयोग करने वाला व्यक्ति:
- भारत के लागू कानूनों का पालन करेगा।
- सही और वैध संपर्क जानकारी देगा।
- किसी अन्य व्यक्ति की पहचान, फोटो, वीडियो या जानकारी बिना अनुमति के उपयोग नहीं करेगा।
- 18 वर्ष से कम आयु होने पर parent/guardian consent के बिना profile submission नहीं करेगा।
- किसी संवैधानिक या राजनीतिक पद के लिए कानूनी पात्रता का दावा केवल इस मंच की profile के आधार पर नहीं करेगा।
4Self-Nomination और Profile Submission
नामांकन करने वाला व्यक्ति यह स्वीकार करता है कि:
- वह स्वयं अपनी profile प्रस्तुत कर रहा/रही है, अथवा संबंधित व्यक्ति की स्पष्ट सहमति प्राप्त है।
- दी गई जानकारी, दस्तावेज़, फोटो, video और declaration उसकी जानकारी के अनुसार सत्य हैं।
- वह किसी व्यक्ति, संस्था, दल या समुदाय के विरुद्ध झूठी, अपमानजनक या मानहानिकारक जानकारी प्रस्तुत नहीं करेगा।
- profile प्रकाशित होने से पहले THE NAYAK आवश्यक basic verification, clarification, correction या removal का अनुरोध कर सकता है।
- profile submission या publication से कोई राजनीतिक समर्थन, चुनावी टिकट, कानूनी प्रमाणन या चुनावी पात्रता प्राप्त नहीं होती।
5Profile Publication और समान अवसर
THE NAYAK eligible profiles को एक समान standard format में प्रकाशित करने का प्रयास करेगा। किसी व्यक्ति को paid ranking, sponsored visibility, follower count, celebrity endorsement या निजी प्रचार-खर्च के आधार पर विशेष लाभ नहीं दिया जाएगा।
THE NAYAK किसी profile को प्रकाशित, रोकने, संशोधित करने, अस्थायी रूप से हटाने या स्थायी रूप से हटाने का अधिकार रखता है, यदि सामग्री इन शर्तों, Code of Conduct, कानून या platform की निष्पक्षता के विरुद्ध हो।
6जन-प्रतिक्रिया के नियम
जन-प्रतिक्रिया केवल non-binding civic feedback है। जन-प्रतिक्रिया देने वाला व्यक्ति:
- केवल अपने वास्तविक मोबाइल नंबर अथवा पहचान से प्रतिक्रिया देगा।
- fake profile, bot, multiple account या किसी तकनीकी माध्यम से गलत प्रतिक्रिया नहीं देगा।
- धन, उपहार, लाभ, धमकी या प्रलोभन के बदले प्रतिक्रिया नहीं देगा या प्राप्त नहीं करेगा।
- प्रतिक्रिया में अभद्र, घृणास्पद, भ्रामक या मानहानिकारक भाषा का उपयोग नहीं करेगा।
- जन-प्रतिक्रिया को कानूनी वोट, चुनावी परिणाम या जनादेश के रूप में प्रस्तुत नहीं करेगा।
THE NAYAK संदिग्ध, duplicate, automated या नियम-विरुद्ध प्रतिक्रियाओं को हटाने या अमान्य करने का अधिकार रखता है।
7निषिद्ध गतिविधियाँ
उपयोगकर्ता निम्न कार्य नहीं करेगा:
- जाति, धर्म, भाषा, लिंग, क्षेत्र या समुदाय के आधार पर घृणा फैलाना।
- हिंसा, धमकी, उत्पीड़न या भेदभाव को प्रोत्साहित करना।
- झूठे आरोप, impersonation, fraud या identity misuse करना।
- platform को चुनावी वोटिंग, उम्मीदवार चयन या राजनीतिक प्रचार का माध्यम बताना।
- website, OTP system, database या अन्य तकनीकी व्यवस्था को नुकसान पहुँचाने का प्रयास करना।
- बिना अनुमति website content, profiles, videos या personal data को commercial use के लिए copy, download, sell या misuse करना।
8Founding Committee के संबंध में
Founding National Civic Committee या Founding State Civic Committee में आमंत्रण केवल अभियान की civic-awareness और leadership-development गतिविधियों में सहयोग के लिए है। यह किसी व्यक्ति को चुनावी उम्मीदवार, राजनीतिक प्रतिनिधि, अधिकृत प्रवक्ता, कानूनी रूप से सत्यापित व्यक्ति या किसी दल का समर्थित सदस्य घोषित नहीं करता।
9Intellectual Property
THE NAYAK, logo, campaign name, website design और platform सामग्री पर संबंधित बौद्धिक संपदा अधिकार THE NAYAK अथवा संबंधित अधिकार-धारक के हैं। उपयोगकर्ता अपनी submitted content का मालिक बना रहता है, लेकिन profile submission के माध्यम से platform को उसे प्रकाशित, display, moderate और campaign purpose के लिए उपयोग करने की सीमित अनुमति देता है, जैसा कि Consent Policy में वर्णित है।
10Privacy और Data Use
व्यक्तिगत जानकारी का संग्रह, उपयोग, सुरक्षा, correction और deletion Privacy Policy तथा Consent Policy के अनुसार होगा। उपयोगकर्ता अपनी personal data rights के लिए प्रकाशित grievance/contact details पर संपर्क कर सकता है।
11शिकायत और Content Removal
यदि किसी व्यक्ति को किसी profile, content या feedback पर आपत्ति है, तो वह Complaint / Grievance Form के माध्यम से शिकायत दर्ज कर सकता है। THE NAYAK शिकायत की समीक्षा कर आवश्यक कार्रवाई कर सकता है, जिसमें clarification, correction, temporary restriction या content removal शामिल हो सकता है।
12Suspension और Termination
THE NAYAK बिना पूर्व सूचना के किसी account, profile, feedback या access को suspend अथवा terminate कर सकता है, यदि उपयोगकर्ता इन Terms, Code of Conduct, लागू कानूनों या platform की सुरक्षा एवं निष्पक्षता का उल्लंघन करता है।
13Disclaimer और Liability
THE NAYAK participants द्वारा प्रस्तुत जानकारी, विचार, video, documents या opinions की पूर्ण सत्यता की गारंटी नहीं देता। Profile publication किसी व्यक्ति के चरित्र, कानूनी स्थिति, चुनावी पात्रता, सामाजिक प्रतिष्ठा या भविष्य की सफलता का प्रमाण नहीं है।
उपयोगकर्ता वेबसाइट का उपयोग अपनी जिम्मेदारी पर करता है। कानून द्वारा अनुमत सीमा तक THE NAYAK किसी user-generated content, technical interruption, third-party misuse या अप्रत्यक्ष नुकसान के लिए उत्तरदायी नहीं होगा।
14Terms में परिवर्तन
THE NAYAK समय-समय पर इन Terms of Use को संशोधित कर सकता है। संशोधित शर्तें वेबसाइट पर प्रकाशित होने की तिथि से प्रभावी होंगी। वेबसाइट का निरंतर उपयोग संशोधित Terms की स्वीकृति माना जाएगा।

1Acceptance
By using www.thenayak.in, creating a profile, submitting a nomination, giving public feedback, or using any service on the website, you agree to these Terms of Use, the Privacy Policy, the Code of Conduct, and other published policies. If you do not agree, please do not use the website or its services.
2Purpose of the Platform
THE NAYAK is an independent, non-partisan platform for civic awareness, public dialogue, and leadership development. It enables citizens to present their ideas, social work, understanding of local issues, and development vision.
It is not a platform for elections, voting, vote counting, political ticket distribution, MP/MLA selection, or declaration of election results.
3User Eligibility
A user of the website must:
- Comply with applicable laws of India.
- Provide accurate and valid contact information.
- Not use another person’s identity, photo, video, or information without permission.
- Not submit a profile for a person below 18 years of age without parent or guardian consent.
- Not claim legal eligibility for any constitutional or political office merely on the basis of a profile on this platform.
4Self-Nomination and Profile Submission
A person submitting a nomination confirms that:
- They are submitting their own profile, or have the clear consent of the person concerned.
- The information, documents, photographs, videos, and declarations submitted are true to the best of their knowledge.
- They will not submit false, abusive, defamatory, or misleading information about any person, organisation, party, or community.
- THE NAYAK may seek basic verification, clarification, correction, or removal before publication.
- Profile submission or publication does not provide political endorsement, an election ticket, legal certification, or election eligibility.
5Profile Publication and Equal Opportunity
THE NAYAK will endeavour to publish eligible profiles in a standard format. No person will receive special advantage through paid ranking, sponsored visibility, follower count, celebrity endorsement, or private promotional expenditure.
THE NAYAK may publish, withhold, edit, temporarily restrict, or permanently remove any profile if its content is inconsistent with these Terms, the Code of Conduct, applicable law, or the fairness of the platform.
6Public Feedback Rules
Public feedback is only non-binding civic feedback. A person providing feedback must:
- Use only their genuine mobile number or identity.
- Not use fake profiles, bots, multiple accounts, or technical methods to create misleading responses.
- Not offer, receive, or seek money, gifts, benefits, threats, or inducement in exchange for feedback.
- Not use abusive, hateful, misleading, or defamatory language.
- Not present feedback as a legal vote, election result, or mandate.
THE NAYAK may remove or invalidate suspicious, duplicate, automated, or rule-violating feedback.
7Prohibited Activities
Users must not:
- Spread hatred based on caste, religion, language, gender, region, or community.
- Encourage violence, threats, harassment, or discrimination.
- Make false allegations, impersonate another person, commit fraud, or misuse identity.
- Present the platform as electoral voting, candidate selection, or political campaigning.
- Attempt to damage or interfere with the website, OTP system, database, or other technical infrastructure.
- Copy, download, sell, or misuse website content, profiles, videos, or personal data for commercial purposes without permission.
8Founding Committee
An invitation to the Founding National Civic Committee or Founding State Civic Committee is only for participation in civic-awareness and leadership-development activities. It does not declare any person to be an election candidate, political representative, authorised spokesperson, legally verified person, or supporter of any political party.
9Intellectual Property
THE NAYAK, the logo, campaign name, website design, and platform content are owned by THE NAYAK or the relevant rights holders. A user retains ownership of their submitted content, but grants the platform limited permission to publish, display, moderate, and use it for campaign purposes as described in the Consent Policy.
10Privacy and Data Use
Personal information will be collected, used, protected, corrected, and deleted in accordance with the Privacy Policy and Consent Policy. Users may contact the published grievance/contact details to exercise relevant personal-data rights.
11Complaints and Content Removal
Any person who objects to a profile, content item, or feedback may submit a complaint through the Complaint / Grievance Form. THE NAYAK may review the matter and take appropriate action, including clarification, correction, temporary restriction, or content removal.
12Suspension and Termination
THE NAYAK may suspend or terminate any account, profile, feedback, or access without prior notice where a user violates these Terms, the Code of Conduct, applicable law, or the security and fairness of the platform.
13Disclaimer and Limitation of Liability
THE NAYAK does not guarantee the complete accuracy of information, views, videos, documents, or opinions submitted by participants. Publication of a profile is not proof of a person’s character, legal status, election eligibility, social standing, or future success.
Users access and use the website at their own responsibility. To the extent permitted by law, THE NAYAK will not be liable for user-generated content, technical interruptions, third-party misuse, or indirect losses.
14Changes to These Terms
THE NAYAK may update these Terms of Use from time to time. Updated Terms will become effective on their publication on the website. Continued use of the website will be treated as acceptance of the updated Terms.
